Terms of use
Nomzo used to be called Ballpark. It's the same app from the same company, and a Ballpark Pro subscription is a Nomzo Pro subscription.
By using Nomzo you agree to these terms. They are short on purpose.
What Nomzo is
Nomzo takes a photo of your food and returns a rough calorie estimate. Depending on your device and when you started using it, Nomzo comes either with a free tier (30 photo estimates per calendar month and unlimited text or voice logging, for as long as you use it) or with a Nomzo Pro subscription required to use the app, which may start with a free trial. On iPhone, new installs from version 1.1 on need Pro. The app shows which applies before you're asked to pay anything, and anyone who already had the free tier keeps it.
Estimates are rough, not medical advice
Every number Nomzo shows is a rough estimate and it can be off, sometimes well off. Nomzo publishes no accuracy figure and makes no accuracy claim. It shows a range instead of one confident number, and that roughness is the product, not something the app pretends around. Nomzo is not a medical device and its numbers are not medical, dietary, or health advice. If you manage a medical condition, an eating disorder history, or a clinically supervised diet, talk to a professional and use tools built for precision.
Nomzo Pro
Pro is an auto-renewing subscription that adds unlimited photo estimates and access to a year of history. Two options are offered: yearly and monthly. A third, a yearly plan at a lower price, is sometimes offered (see below). The exact price, billing period and any free trial are shown in the app at the moment of purchase, in your local currency, before you confirm anything.
- Payment is charged to your Apple ID or Google Play account when you confirm the purchase, depending on where you downloaded Nomzo.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
- You can cancel anytime in your App Store or Google Play subscription settings. Deleting the app does not cancel a subscription.
- Refunds are handled by Apple or Google under the terms of the store where you purchased the subscription.
- You can restore a previous purchase from the app's Settings screen, or from the subscription screen during setup.
Free trial
The yearly plan may start with a free trial. Its length (currently 7 days) and the price it turns into are shown next to the button before you start it.
- Nothing is charged during the trial. When it ends, it converts to the paid yearly plan and you're charged the yearly price, unless you cancel at least 24 hours before the trial ends.
- Cancel the same way as any subscription: in your App Store or Google Play subscription settings. Cancelling during the trial means you're never charged, and Pro stops when the trial ends.
- A free trial is available only once per person per Apple or Google account, and a trial on one Nomzo Pro plan normally rules out a trial on the others. Apple or Google decides who's eligible. If you aren't, the app shows the plain price instead and there's no trial.
- The monthly plan has no free trial.
The discounted first-year offer
If you back out of a purchase during setup, Nomzo may offer, once, a yearly plan with a discounted first year (currently €19.99 for the first year in the eurozone and US $19.99 in the US, then the standard yearly price of €39.99 or US $39.99 a year; always shown in your own currency before you confirm).
- It's the same Nomzo Pro, with the same features as the standard yearly plan.
- It's only offered if Apple or Google says you're eligible for an introductory offer, which normally means you haven't had a free trial or another introductory offer on any Nomzo Pro plan.
- On the App Store there's no free trial: you're charged the first-year price when you confirm. On Google Play it starts with a 7-day free trial (see above), then you're charged the first-year price unless you cancel at least 24 hours before the trial ends.
- After the first year it renews at the standard yearly price every year until you cancel.
- Renewal, cancellation and refunds work exactly as for the other plans.
Age
You must be at least 13 years old to use Nomzo.
Your data
Your food log lives on your device. How data is handled is described in the privacy policy, which is part of these terms.
Fair use
Don't abuse the service (for example, automated or bulk requests to the estimate API). We may rate-limit or block abusive traffic to keep the app working for everyone.
Liability
Nomzo is provided as is. To the extent the law allows, we are not liable for decisions made based on rough estimates, which is also why we keep telling you they are rough. Nothing in these terms limits rights you have under mandatory consumer protection law.
Governing law
These terms are governed by the law of the Republic of Lithuania and applicable EU law. Mandatory consumer protections of your country of residence still apply.
Changes
If these terms change materially, we will update the date above and note it in the app's release notes.
